It may even be Mail Fraud which I think is a Federal Offense too

I don't know if it would qualify as mail fraud, since he never claimed to have actually shipped me anything.

Non-delivery or misrepresentation of mail-order merchandise, order an item, make payment, receive nothing is the simplest form of mail fraud.

I have not heard anything form Ian since the E mail in November. He remains unresponsive to any of my E mails. I have noticed that the M2 is up on the site again for $895. He is still not taking new orders however. There is a whole slew of new truck parts are also for sale. I am still trying to remain patient, not particularly happy but . Patient. Not much else I can due but keep waiting. He post a good bit on this forum: link to M2 thread below www.airsoftpacific.com/viewtopic.php?t=15423

I am trying to be patient as well, it is the only thing I can do from 5800 miles away. Anyway, Ian has not been very active in the forums that he usually posts, being the last post in the arniesairsoft forums on Jan, 14th..
What he cannot afford is to have unhappy customers in both sides of the Atlantic ocean as bad reports spread like fire in airsoft forums, which if he does not put any remedy to the actual situation, will happen very soon.

So that's jeep, nekros and myself waiting for this pro. Anyone else? Did we all pay with a credit card? Rumor has it they can put some pretty significant leverage on him to resolve this matter. (as in, you can't take anymore until you fix this.)

Write him a letter giving him a deadline for delivery or refund. If he doesn't comply, tell him you will be contacting:
1) his local police department to report theft 2) his State District Attorney 3) the Better Business Bureau
Of course, you have to be prepared to follow up on the threats.
That will get him off his ass, almost guaranteed.
It's amazing that anybody is so flagrant with shoddy business practices anymore. Word like this gets around very quickly on the net. It's financial suicide.

I don't think it is the same as WW2guns. I think Ian has/had every intention to deliver said product but is overwhelmed. Not an excuse but a reason.

I think Ian . . . had every intention to deliver said product but is overwhelmed. I completely disagree, for several reasons. 1)Overwhelmed or not, you must still communicate with your customers. 2)Overwhelmed businesses should be scrambling to fulfill previous commitments, not designing totally new weapon systems.(or is there an R&D department?) 3)If you're product is selling so well you can't keep up with demand, why diversify and start selling completely unrelated products?(see the gussy-bits for GM trucks .) 4)If you're that far behind, why wouldn't you issue a refund if the customer wants one? One less job to be late on. Yada, yada yada.

Truthfully it took some very pointed emails from me to get him to respond. As you have all read from my previous posts, he sent me sub-standard product to get me off his back and has yet to make good on his promises to make things right. My biggest gripe with him, is all the time he spends posting all the cool new toys he 1-offs, instead of working on PAYING customers items. Very unproffessional! Your best bet to get any response, is to not be nice!

From his introductory offerings beyond the simple .30 Cal patterns I felt he was priced too low to have a viable business offering. Considering the work involved it simply didn't make sense. I bought a couple of .30 Cals which took a while to get but were as advertised and overall I was quite pleased. He even sent updated revisions for the cost of shipping. I suspect at some point in the process he realized it really wasn't a profitable enterprise and got less and less enthusiastic about the effort.
There are a lot of enthusiastic hobbyist who want to turn their passion into a viable business and soon discover it doesn't pencil or they really aren't cut out to be a manufacturer. I think his talent lies in design and development NOT Sales or manufacturing. I hope he gets on top of things and gets everyone delivered as his offering are a great additional offering for our hobby.
Continued pressure is your best bet I suspect.

Well, here's the latest. I don't feel I should have to pester someone just to receive a product I paid my hard-earned money for. So I sent him one last triple edged e-mail. This was the gist of it. Refund my money by midnight on Jan. 27th, or: 1. You will be reported to Visa. 2. You will be reported to the state's Atty. Gen. 3. I will join every airsoft forum board I can find to share the joys of my experiences with Air-Sharp. I then joined a couple of forums, just to send him PM's saying "howdy." ;D Well, the smoke round must have landed between his feet, because this morning I have an e-mail containing a UPS tracking # for the M2. The cradle is still "processing" I wanted a refund. I won't consider half of my order to be a pacifier. I am tempted to decline the package on principle. It's Sunday, he couldn't have shipped it today.

At least you got a response, I think half of my issue is I ordered a M2 that was supposed to have a M14 mechanism inside it. He is using M249 gear box mechanisms now and I bought it on sale. He is taking a hell of a hit on this already BUT, I ordered a age ago I do NOT want a refund I want the replica I paid for. I am getting impatient for it. I want so badly to be able to review a fantastic replica that I can recommend to every one but the wait is definitely starting to color my attitudes right now. I was pissed off earlier last year and calmed down, NOW I am working into a full on pissed off again. Hopefully, your "spotting round" will light a fire under him. If I don't hear something soon I'll call for fire for effect.

Went to check on my orders this morning and got this: 145 - Table './sharp_osc1/sessions' is marked as crashed and should be repaired select value from sessions where sesskey = 'ca02b016b74ff5688dceb76fe7eabaed' and expiry > '1233232402' [TEP STOP] Interesting.

I'd contact your credit card company. Your protection at this point may have expired but it's worth checking on. I agree that at this point you absolutely should NOT accept a partial order. For Gods sake it's been how long? ? Ian is clearly way beyond swamped. He got Sunamied long ago and never recovered to the detriment of the entire community. Get out any way you can. That goes for everyone else with pending orders.

At last I have received an answer from Ian. He sent an email with pictures of a few M2 in process. I would post the pictures, but I am not using my computer now, I will do it tomorrow at 8:00, what it means around 00:00 for all of you in PST timezone. Call me a fool, but his email makes me feel much more confident

Pretty sure those are the same ones he's posted in the marketplace thread. Save the energy. I am entertained by the shot of the current newspaper sitting on them, as proof that they are indeed "alive".(like a ransom hostage) That's a statement in itself.
I gave him the opportunity to fill both of my orders by next Wednesday, or I will release the hounds. I really do hope he comes through. I hate dealing with legal crap, but that doesn't mean I won't.

Here is my update on the Air-Sharp M2HB .50 cal. thus far. Ordered on 23Jun08. Received on 10Feb09. Unpacked from the box, the first thing I noticed (besides the giant size) was that there was no outer barrel inside the heat shield. So when assembled the inner barrel is plainly visible inside the shield. The assembly of parts was rushed and it shows. Many things do not line up correctly. The work-worn finish looks more like sponge painting, but that's easily remedied. The inner barrel was very nice, a JB Unicorn. The hop-up was brand new, unassembled. Mate those together, and it's time to mount the gearbox. The instructions are a series of pictures in an e-mail. That's it. The gearbox comes attached to it's base plate, and is hard wired to the relay and the switches mounted on the trigger/handle/rear receiver plate. The base plate on mine was not built correctly, causing the mechbox to sit with a downward angle. This would cause damage to either the air nozzle, the hop-up, or both. I was able to remove the box mounting plate from the base plate and re-attach it so the mechbox would sit in line with the hop-up and barrel. The hop-up "tower" was not moved. The receiver and base plate were pre-drilled, as was the magazine feeding tube hole in the left side of the receiver. From the pictures I could tell you assembled the hop-up and installed it on the barrel, then took a 3/4" piece of (AEG?) spring(included), slid that over the barrel followed by a round plastic disk with a barrel sized hole in the middle. You then insert the barrel into the hole in the front of the receiver, the plastic disk covers the hole so the spring pushes the hop-up toward the mechbox and into the hop-up tower when the base plate is attached. Unfortunately mine was drilled incorrectly and when assembled as instructed the base plate was a full 5/8" too far back to line up with the holes for the screws and the feeding tube. I was able to remove a piece of the front plate of the receiver, gaining 1/4" and possibly a way to install the missing outer barrel section in the heat shield. There were pieces of plastic glued inside the lower edge of the receiver where the base plate mounting screws were drilled, presumably to reinforce the holes. Two of them busted off by hand. I removed the other two with a razor saw. I fashioned four new ones from the piece of plastic I removed from the front of the receiver and mounted them where the holes would need to be. I then filled the old screw holes in the receiver and drilled the new ones and attached the base plate. I then drilled the new feed tube hole. I then attempted to mount the rear plate to the receiver, and it too was malformed. I made a shim to fill a 1/4" gap between the top of the receiver and the top of the rear plate and it fit okay. I then installed the feed tube and connected the magazine to it, plugged it in to the harness and connected a large 8.4v battery. I looked for a way to "prime" the feed tube, but found no way to do so without dry firing the mechbox. It eventually filled the tube, but fed erratically. I did not want to run the thing in my apt. anymore, so I figured I'd wait until I was somewhere I could take it outside to finish troubleshooting it. This past weekend I was at an event and had the opportunity to take it out and run it. I set the gun, cradle and tripod on a bank of snow and one leg broke off the tripod. I rearranged the snow so it would support it without the leg, connected everything and pulled the trigger. Nothing. I wiggled the battery connector and it began to fire, but no BB's were feeding up the tube. I tapped on the box mag to jostle the BB's but no change. I could feel something running in the mag, but nothing was coming out. I disconnected the feed tube and got a fountain of plastic. Okay, it was running. I then re-inserted the feed tube into the magazine and hit the trigger. The mechbox went "zZZZZZzzzzzzzzzzzzzzzzz. A free spinning gear set, how lovely. I put the gun back in the cabin and brought it home after the event. i have yet to dismantle the box. In summary, I would like to reiterate this is not a review, it is an update on why I haven't yet written a review. When the gun actually shoots something I will write a review, but at that point how much of the review will be of the product and how much will be of my own work? Update 2-25 I got the mechbox apart and found the piston had bound at the rear of it's travel due to a bent final gear axle. I replaced the gear and re-shimmed, re-assembled and it seems to run fine now. Tomorrow I'll put it in the gun and see how it does.

Yikes. It good that the barrel is so long so you won't be tempted to put the muzzle in your mouth and pull the trigger! What a nightmare! Sorry to hear about the litiny of troubles and hope you eventually get it all sorted out. It's a good thing you are handy!
